Pursuant to Section 53, Municipal Elections Act, 1996

 

November 5, 2021

 

WHEREAS on April 1, 2021, Premier Ford announced a province-wide lockdown for twenty-eight days effective April 3, 2021;

AND WHEREAS Section 12 of the Municipal Elections Act, 1996 provides that the Clerk is responsible for the conduct of the municipal election and may provide for any matter or procedure that in the Clerk’s opinion is necessary or desirable for conducting the election;

AND WHEREAS the Acting County Clerk declared an emergency on April 6, 2021, in accordance with Section 53 of the Municipal Elections Act, 1996, being of the opinion that circumstances arose that were likely to have prevented the election being conducted and upon declaring such emergency the Clerk made such arrangements as considered advisable for the conduct fo the Ward 2 By-Election consistent with the principles of the Act;

AND WHEREAS the 2021 Ward 2 By-Election has now concluded and the period during which a person entitled to vote in an election may make an application to the Superior Court of Justice regarding the validity of the election has now duly passed

NOW THEREFORE I, Teresa Olsen, County Clerk, Norfolk County, hereby declare that the Emergency Declaration issued on April 6, 2021, subject to the authority of Section 53 of the Municipal Elections Act, 1996, for Norfolk County shall now be concluded.
