Norfolk County raises concerns about the rising costs of frivolous and vexatious actions
Norfolk County is raising concerns about frivolous and vexatious actions against the County that cost taxpayers, even when the complaints, appeals or legal actions are dismissed and found to have no merit.
Frivolous and vexatious actions refer to complaints, lawsuits or requests that have little or no merit, are repeatedly brought forward without new evidence, or are made in bad faith. Under current provincial legislation, municipalities are required to respond to these actions, which can lead to unplanned legal and administrative costs, delays to regular service delivery, and fewer dollars available for community priorities.
To put these costs into perspective, funds spent responding to a single action could have helped pay for projects such as a new ice resurfacer at the Langton Arena, roof repairs at the Waterford Library, or accessible washrooms at the Delhi Museum.
Norfolk County has contacted the Province of Ontario to introduce changes to legislation that would give municipalities better tools to address these types of actions. The County has asked for clearer definitions of frivolous and vexatious actions, the ability to dismiss baseless matters earlier, stronger options to recover costs when public resources are misused, and safeguards that protect transparency while discouraging abuse.
Norfolk County recognizes that transparency, accountability, and oversight are essential parts of local government, and that residents must have the right to raise concerns, ask questions, and access information.
Staff will continue to track and report costs related to these actions through the County’s financial reporting and budget process.
