TAKE NOTICE that the Council of the Corporation of Norfolk County passed By-Law Number 2020-104 to extend Interim Control By-Law 2019-89 at their regular meeting of December 15, 2020 under Section 38(2) of the Planning Act, R.S.O. 1990, c. P. 13.
AND TAKE NOTICE that any person or public body may, within 60 days of the notice given, appeal to the Local Planning Appeal Tribunal (LPAT) in respect of the By-Law by filing a notice of appeal setting out the objection to the by-law and the reasons in support of the objection with the Clerk of Norfolk County. The last day for filing the appeal is 4: 00 p.m. Friday, March 26, 2021.
If you wish to appeal to the Local Planning Appeal Tribunal, a copy of the Appellant Form is available from the LPAT website at www.elto.gov.on.ca. The Appellant Form must be accompanied by the LPAT’s required fee of $1,100, though the fee may be reduced to $400 when requested by those who are eligible at the time of the filing. Fees are payable by certified cheque or money order and should be made payable to the “Minister of Finance”. You must submit the completed Appellant Form and prescribed fee to the attention of the Clerk, Norfolk County, 50 Colborne Street South, Simcoe ON N3Y 4H3, due to Covid-19 Closure appeals may be delivered through the drop box at the above location or through registered mail.
Only individuals, corporations and public bodies may appeal a By-Law of Norfolk County to LPAT. An appeal may not be filed by an unincorporated association or group.
However, an appeal may be filed by an individual, with authority, on behalf of the incorporated association or group. Planning Act sections 34(23) to (26) apply with necessary modifications to the appeal, including that persons or public bodies may not be added as a party to the hearing of the appeal unless, in the opinion of LPAT, there are reasonable grounds to add the person or public body as a party. Unincorporated associations may not be parties, but an unincorporated association may seek standing as a party, pending confirmation of its incorporation.
