New Zoning By-Law

Community Planning Staff are preparing a new Comprehensive Zoning By-Law and need your input.  The Second Draft of the Comprehensive Zoning By-Law is now available for public review and comment.


 

Norfolk County Comprehensive Zoning By-Law

In 2010, Norfolk County Community Planning Services started the Zoning By-Law project. A new Comprehensive Zoning By-law for Norfolk County has been recognized as being necessary due to municipal restructuring and to incorporate the policy direction of the Norfolk County Official Plan that was adopted by Council on May 9, 2006 and approved by the Minister of Municipal Affairs and Housing on December 23, 2008.

Within Norfolk County, there are currently four Zoning By-Laws in effect covering the former municipalities of Norfolk, Delhi, Simcoe and Nanticoke. The Simcoe and Nanticoke By-Laws are of relatively recent vintage having been passed in 1999 and 2000 while the Delhi and Norfolk By-Laws date back to 1980 and 1985 respectively. The new Norfolk County Zoning By-Law will implement the policy direction of the Norfolk County Official Plan and provide for one Zoning By-Law applicable to the entire County.

The 1st Draft of the Comprehensive Zoning By-Law was available for public review and comment in 2011. Council has recently reviewed the Second Draft and authorized staff to release the document for public consultation at their Council-in-Committee meeting on October 10, 2012. The Second Draft of the Comprehensive Zoning By-Law is available in two parts: the By-Law document and the related maps. Copies of the Second Draft of the Comprehensive Zoning By-Law are available for review at the following locations:

  • Simcoe Administration Office – 50 Colborne Street South
  • Simcoe Planning Office – 60 Colborne Street South
  • Delhi Administration Office – 183 Main Street of Delhi
  • Langton Administration Office – 22 Albert Street
  • Norfolk County Library – Simcoe Branch – 46 Colborne Street South
  • Norfolk County Library – Port Dover Branch – 413 Main Street
  • Norfolk County Library – Delhi Branch – 192 Main Street of Delhi
  • Norfolk County Library – Waterford Branch – 15 Main Street South
  • Norfolk County Library – Port Rowan Branch, 1034 Bay Street

A Public Open House is scheduled to provide the public an opportunity to discuss the Draft Comprehensive Zoning By-Law with Norfolk County staff. The Open House is scheduled for:

Wednesday November 28, 2012, 5 to 7 pm at Talbot Gardens, Multi Purpose Room, Simcoe

Hard copies of the Second Draft of the Comprehensive Zoning By-Law are available for purchase at the Simcoe Community Planning Office and the Langton Administration Office for a cost of $50/copy. CD versions of the Second Draft of the Comprehensive Zoning By-Law are available for a cost of $5/copy at the Simcoe Community Planning Office and the Langton Administration Office.

Your input is important to this project. We welcome your comments and questions regarding the Second Draft of the Comprehensive Zoning By-Law and encourage interested persons to obtain copies of the Draft Comprehensive Zoning By-Law as noted above, attend the open house and/or submit written comments and direct questions through the contact information listed below. Comments on the Second Draft Comprehensive Zoning By-Law should be submitted no later than December 14, 2012.

Public Consultation

Public Open Houses were held in various locations in the month of June and July of 2011 to afford the public an opportunity to discuss the First Draft Comprehensive Zoning By-Law with Norfolk County staff:

What is a Zoning By-Law?

The basis for zoning is three fold. A municipal Zoning By-law:

  1. Protects Quality of Life / Use of Property / Property Value
    • To ensure that neighbouring uses are compatible
    • To ensure that people can reasonably enjoy their own property
    • To ensure that areas develop based on consistent and equitable standards
  2. Implements the Official Plan
    • Official Plans are not regulations
    • Zoning is the single most important means of achieving the objectives of the Official Plan
    • Section 24 of the Planning Act requires conformity with the Official Plan
  3. To Remove Discretion in Land Use Decisions
    • Zoning By-laws impose a ‘right of use’
    • All property owners are treated equally
